Farmer jailed for fatal trailer smash
A FARMER has been sentenced to two years in prison today (Wednesday, June 30) after a trailer became detached from his tractor, killing a passing motorist.
Alister Clark, a farmer and contractor from Ballindalloch in Morayshire pleaded guilty to causing death by dangerous driving and was sentenced at the High Court in Edinburgh.
The court was told Mr Clark failed to check the trailer was properly coupled with the dolly converter and was also aware that the air brakes on both the converter and the trailer were faulty.
Stuart Reid, 34, suffered fatal head and chest injuries in the accident on the A95 on October 19, 2008 as the trailer, unable to stop due to its faulty air brakes, smashed into his vehicle.
Sentencing, Lord Doherty said Mr Clarke had shown ‘genuine remorse’ and had also shown a desire to have the case publicised so as to act as a warning to other farmers and to highlight their responsibilities when on the road.
However, he said nothing but a custodial sentence would be sufficient to recognise the ‘seriousness’ of the incident.
Commenting on the case a spokesman for NFU Scotland said it was vital farmers recognised their responsibilities when it comes to road safety.
He said: “With harvest just around the corner, this tragic accident serves as a sharp reminder to all farmers to ensure that their equipment is properly maintained, that users are properly trained and that they take extra care to ensure machinery is safely coupled.
“Any accident of this kind is an accident too many and is ultimately avoidable. Farmers must remind themselves of the many rules and regulations surrounding haulage as well as the health and safety implications for them, their staff and other road users.
“I believe the majority of farmers are taking that responsibility seriously.”

This is sad to hear.
However, as an air brake specialist, I am encouraged by the number of farmers and contractors who contact me for advice in order to stay safe and legal.
